Compliance Class: The HMDA Partial Exemption
Relief for small HMDA filers is here! On August 31, 2018, the CFPB issued an “interpretive and procedural rule” which implements and clarifies HMDA changes made by the Economic Growth, Regulatory Relief, and Consumer Protection Act. These new changes reduce the HMDA burdens for small filers by exempting them from reporting a number of data points on their LAR, though HMDA reporting is still required for both large and small HMDA filers.
While one would expect these changes to be fairly simple, the reality is there are quite a few complexities to the new rules. As the rule became effective immediately upon publication in the Federal Register, it is important for smaller HMDA filers to know if and how this rule applies to them.
