Compliance Class: Regulation E Bootcamp
In recent years, Regulation E has evolved from once being a fairly simple rule to now being one of the most complex and challenging deposit compliance regulations to date. Initially released in the 1970’s, many elements of the rule were written long before technology of today would even be thought of. This means, of course, that it can sometimes be challenging to ensure compliance with Regulation E as the rules aren’t as straightforward for today’s technology as they could be. Therefore, it is important for financial institutions to have a strong understanding of the requirements of Regulation E, while also paying attention to recent guidance on the topic.
Our Regulation E Bootcamp is designed to review the requirements of the Electronic Fund Transfer Act (EFTA), as implemented by Regulation E. Knowing that Regulation E can be complex, we take a priority-based approach to the topics of Regulation E when discussing the rules by focusing on the elements that are going to have the biggest risk in your financial institution. For example, we spend a great deal of time on the error resolution requirements and consumer liability provisions of regulation E, while not spending any time on gift cards and prepaid accounts. The goal of this program is to cover the main elements of Regulation E that would apply to your organization, while spending extra time on the areas that have the greatest risk for non-compliance.
Using simple language and an easy to understand format, our instructor explains the requirements of Regulation E (and the commentary) by leading attendees through a comprehensive training manual. Our program is divided up into ten different videos and focuses on the key elements of the EFTA, including the disclosure requirements, opt-in requirements for overdraft protection, consumer liability, and error resolution. While we do provide a brief overview of the Remittance Transfer Rules, its important to understand that this program only provides a high level overview of this topic and does not take a deep dive into Subpart B of Regulation E.
